My wife had a capital one credit card for 300 limit. We didn't max it out, but couldn't afford to make payments on it, and it has racked up to 700. She got a summons today she is being sued for 710, plus 5% interest. We don't know what to do. She is the only one working right now, I am hurt and cant work. I know we owe the money, and if we had it we would pay it. any ideas? I don't have anyone to borrow the money from. I have thought of all obvious solutions.


I had a credit card from Capital One around 3 or 4 years ago, paying on time every month. I lost my job about a year ago and couldn't make payments anymore..Well earlier tonight I was visited by the sherriffs office with a form saying I was being sued by Capital One..I'm still out of a job ( I live in a small dead town). I need advice on what to do..I'm supposed to submit a defense on why I hadn't made payments. I have friends telling me not to worry about it since I have no income coming in, they can't do anything about it...don't think I should be taking their advice though..
My question is whats the worst they can do to me since I have no income coming in and I have no property worth that much...


I am being sued by Capital One for a credit card debt less than $900. What can I expect in court?? I have absolutely nothing to my name except student loan money (no house, no car in my name, no fancy electronics, etc...) I have a pre-paid credit card, can they freeze or take that? I do prepaid because I'm tired of fees that bank charge you. I don't plan on not going to court because I hear the best thing to do is show up.

i got this prepaid Debit Card and today i called the Company that Said they would Help Me With my Debit Card because they Sent me a letter in the Mail i Have a Credit Card with Capital one and i haven't Paid it so The Company Said that They worked With Capital one and they Said that They Could Lower the Amount So i Said Great and the Person said that There Going to Take out $154 on the 4TH OF November
so i just Happen to Look online and there Are people saying that These People Scam Them and That They Said that They Would Help Them but just Took the Money out of there Account... my Problem is that i Get a Check Direct Deposit On the 3rd And i Can't Cancel the prepaid Card Because if i do i will not be able to get my money so what Should i Do

Even though I don't use it. For example, this month it says my balance is $.50 even though I haven't used it at all. Do I always have to make some sort of payment? Will it give me a credit for when I actually do spend the money? Thanks

It's a capital one card


I had a few loans out through my significant other, one small one that i used for a car about $6,000, one larger one for about $28,500, and then we had some combined stuff to do around the house, etc, so that was a home equity for about $30,000...all in all those were gotten about a year or two fairly closely together though, and they all started out as lines of credit, fixed interest rates.

We both kept making payments on time, and were on great terms, then this whole credit crisis hit...our credit cards, some of them, the limits got slashed, one or two just closed.....then two of these lines of credit became variable rates...and then if that wasn't enough, they reduced the terms from lets say 6 and 8 years down to 5, just like that...

and just today I found out that they're freezing them, the two of them, and they're no longer lines of credit just simply loans..which totally eradicates drawing more on it lets say at a later date.


So now I especially am very angry, because I feel like we're being messed around by these banks just because they "can," even though we have good if not great credit, make our payments on time, and that's actually not THAT bad of outstanding debt being that it's not all under one person's name.

it's just ridiculous though. We've been paying them down, and we still have alot of other credit available that we NEVER use, and income is good..everything is good.

So now I'm depressed, becuase in the last year, with all this slashing, it put a serious dent into being able to withdraw espeially for necessary things like health bills.


So as of right now I want to know what the best option would be?

Should I just let things go how they are, or should I try a different bank and then just consolidate a few into one bigger loan, or try to get a line of credit and just transfer over and pay off the, forgive my language, cr@ppy loan deals we now have?

Another concern is, with this outstanding debt, which isn't astronomical but it's still quite a bit...

will they be less likely to approve, especially if it's secured? Does going in person help any..rather than just over the phone and internet, and perhaps putting up a collateral or securing it with something might help?



The thing is, I used personal lines of credit to have as a safety net, just in case emergencies come up, I mess up and over spend,, or whatever financial crisis may arise especially in THIS economy, and it's something that you pay down but can also reach in if you need it.

IT's great for rescues, but now banks are seriously cutting that down, and well....not much is available.


So I'm very upset over it. I mean I can understand the economy being bad but...these banks aren't even giving out notices ahead of time to WARN us about changes@!

They NEVER notified us about this recent change where they're just becoming loans and not lines of credit which we got APPROVED of.

no letter in the mail, just happened.

They even treat their LOYAL customers like dirt and we've been banking with them for a long time now!

What are our options? I don't want to go into some debt consolidation thing either because I can totally pay off the bills from the loans etc, tey're not that much considering they're spread out for many years, and they serve a great purpose to withdraw money from if they're lines of credit.
also, once the banks do this, are these permanent changes or can they be subject to change? Bank of America's reasoning was : well we just don't DO lines of credit anymore.

Fine, but why should we then bank with them?

It's our money too we're paying back, so why pay under one bank's conditions & terms you don't agree with.

If another bank is more negotiable and nice to their customers & offers better rates/plans.....then...why stick with bank of america?


They seem very blase about actually working with you. IT's more like...this is what we offer, this is not, take it or leave it GOODBYE, no care about good customer service or a good payment history NOTHING.


I feel like a number and they treat you almost condescendingly.


Well why do banks offer these services...if they later complain that people shouldn't be USING THEM? It's a catch 22, if no one used them...their businesses wouldn't be as successful.

I recently turned 18 and would like to start building credit.

I don't have a bank or checking account, I don't have a job yet, but my mom will be paying it off till then, and I am not in school(overcrowded)

So whats is a good credit card for a first timer, is capital one a good chose, oh and what should I look for in a card(i.e.no annual fees)
Oh and I dont really need rewards like air points or whatever they're called.


I have a credit card with Capital One. I recently lost my job, I'm about 40% over the limit, and have been making payments under the minimum requirement. I completely understand them calling me, TO A POINT. I have received an average of about 15 calls a day, and it's been going on for literally months. Yesterday for example, I received 17 calls from them, and it's not even the 17 times I'm upset about, it's the fact that they started their calls at 5:17am. Then again at 5:32, 5:57, 6:32, 7:29, 8:40, and so on. I know that according to the FTC, they may only call between 8am-9pm, and so I'm assuming they're breaking the law? If so, can I sue them for harassment?


i left my husband today. i left him and traveled 85 miles back to my parents house. i tried but he never cared. i feel kinda sad, and kinda like crying , but i dont want to cry . i dont want to hurt myself anymore. whats next? anyone else leave their husband? how does divorce work? where do i go? also he opened a credit card under my name, how do i make him pay for what he spent. he maxed it out and never payed it off. now i owe 900 to capital one. what can i do?


if economic recovery has truly begun all the companies that got bailout funds (aig, gm, chrysler, bofa, etc etc) should return the bailout funds 100%. This is just not the case.

And after taking bailout money to balance their own books, banks like Chase, Capital one, etc etc boast of making profit. And that makes wall street happy. But in reality that is no true profit. It is just fooling everyone -- like Bernanke and Obama advisors do.

And even now Obama aides say he is preparing a second bailout package for small banks which is up to $5 billion. Despite all this bailout stuff, 105 banks still failed and had to be shut down by FDIC. And 413 more banks are on "danger of closing" FDIC list.

Foreclosures, credit card delinquencies, and loan defaults are rising sky high and everyone is in debt till their eye balls. How then does Obama and his circle say, "recession has ended", and "recovery has begun"?


i want to build my credit and capital one is the only card that accepted me... its a simple 200$ limit should i keep it...?


I had received a capital one credit card in 2008. It had a limit of $250.00 on it. Well, I made li$15.00 per payment. So I payed $30,00 altogether. Well, I didn't have the money to pay for it, so I didn't contact them. Well here it is 2009 of October and I received a letter from the company's lawyer saying the are going to sue me for $700.00 plus crude interest. I don't understand where the $700.00 came from. I want to know if I can stop the court process and just pay them $700.00 and then pay off the interest in increments? Will I go to jail? How can I fix the issue so I don't have to go to court, because I don't want them to garnish my check, when I finally do get a job. What should I do?

i am over the limit on one of my capital one cards. i am NOT past due and am still making payments. they have placed me in collections for being over the limit ( my credit limit is 500 my balance is 589.64) and are saying they are going to charge off my account as bad debt, is that legal?


we put maybe $9k or so on our personal credit cards, and we plan to own and run the LLC 50/50 just us 2. Is the $9k considered our initial capital investment for purposes of completing our Operating Agreement? We just filed the LLC today, we started the business 60 days ago and have spent $9k of credit cards to this point. We expect to spend another $2k then we will be able to use operating profits to pay them back and run the business going forward. So thoughts on the capital investment would be appreciated. There are a few items which have been reaged by a collections agency and they cannot do that. The SOL has passed and they should be removed from my credit report. Also, when you view your credit report where is the "date of last activity"? All I see is the open date and last reported date. The last reported date can't possibly be the date to go by because then the companies can stay on your credit report forever. I have never had problems about stuff dropping off before but Capital One refuses to drop off and the three different collection agencies (for one card mind you) keep reporting a new date opened. This is ridiculous. How can I get them off? It has been 8 years now and they are still on there.


Hello, I've just received a letter from capital one stating that the interest rate on my credit card will be increasing from 29.9% to 39.9%! Is this even legal? It just seems that this amount of interest rate is ridiculous. I will be of course cancelling my credit card and finding a new one, which leads me to my second question:

My credit score is quite good but I have only lived in the country for 2.5 years. Someone I worked with said that you need to live here for at least 3 years before being able to get a decent credit card. Is this true?


Hi! I've defaulted on a Capital One card and it is now with a Debt Collections Firm. I cannot pay the full sum they're Demanding (including their so-called "payment plan").

HOWEVER *On a Mastercard that I am now in good standing with but was formerly overlimit on (but not in collections) The Mastercard rep mentioned that if I continued to make payments on that card -even if it didna��t meet their minimum request, that her employer could not send me to collections or take any other type of legal action.

*Does this rule apply to Capital One card *Collections? Even though it's in collections (threatening legal action),

IF I MAKE AN ONLINE PAYMENT TO THE CARD ORIGINATOR, CAN THE COLLECTIONS FIRM STILL PUT A LIEN ON MY CHECKING ACCOUNT?

I have a credit card with Capital One. My payments are due on the 19th of every month. I made it a point not that long ago to log on my computer ONLY to pay my credit card billl. And I paid more than the minimum. Now I log onto my Capital One account and I have a late fee of $40. I checked my bank account and my payment never went through, but I remember the Capital One site saying it had posted... but I don't have record of it, because I had never had any problems with it before.

I KNOW that I paid my bill on time. What is going on here? I have never been late on a payment, do you think I could get the $40 fee removed?

I have about six credit cards, all with limits between $2k-$7k except for one which has a limit of only $500 AND it has a $39 annual fee. I pay off my cards completely each month so I never carry balances, but having a card with such a low credit limit (they will not increase the limit although I've had it a couple years, and Capital One won't take requests to increase the limit) irritates me when the others always increase my limit. I have always paid on time. Should I...

1. Just ask them to remove the annual fee, or else I'm closing it
2. Just ask them to close it
3. Still request a credit line increase anyway

How does closing one card affect your credit score? I'm not looking to make any large purchases for several years, at least 3-5, so I'm not too worried about any short-term effects.

I have been waiting for over a month now for my Capital One card to arrive and it still hasn't. Half the time I call their customer service line, the employee says that the system is updating so I should call back in 2 hours. Instead I call back in 10 minutes and find someone who actually wants to talk.
I am thinking of cancelling my card and hoping that someday I actually get my $300 back.
They had such wonderful television commercials in the past, so you begin to trust that this is a reputable company. I don't think so anymore! The reviews I have read on the web are terrible also!

When i get a credit card, do I get a certain amount a month, and pay a certain amount monthly, and then every month it starts over. or is it a totally different thing?


Also, can I apply for a credit card, and when it gets sent to me in the mail, if i decide when i get it that I dont want it, will that affect my credit?

I have bad credit, but I managed to purchase a new car with a high interest rate. My auto loan is through Capital One. The credit card offer is from Capital One because I've made timely payment to them on the loan for 1 year. Would accepting the card help raise my FICO score or hinder it? I thought that applying for new credit cards lower the score.


okay so a few years ago i got a capital one credit card and ran into some hard times and had to use it to pay bills and stuff so anyways i wasn't able to pay them back and it went to court and i got a judgement. the whole thing was finalized towards the end of last year...so anyway i just opened a new bank account about a week ago and deposited a 2300 check. because of the judgement will they take my money from my new account?


We received a letter saying that he was being sued by Capital One for a debt owed. His credit limit was $300, but they're saying over $700 is owed. I've done a lot of research on this, and some people are saying it's illegal for them to do so and whatnot. But anyway, his court date is tomorrow morning and we're a little unsure about what could happen. He does not have an attorney. What are the normal court procedures? Can someone give us some advice on how to handle this tomorrow morning?

Jack - There's not much more to the story then what's above. I was pretty shocked myself - it happened over a year ago, and about 4 months ago he received something in the mail saying they were suing and that he needed to go to court.
Of course it should've been paid, but bad decisions were made and now we're in this predicament.


I was raised with the idea that credit cards are bad and lead to even more debt. So, I don't own any credit cards. I merely have a checking/savings account. I was formerly in the military so I've never been in a stable residence. My husband wanted to get a new car but his credit score was in the 600's and he had some loans out so they said he would need a co-signor. They told me that I am a ghost, have no credit, and basically am in purgatory so me co-signing with him wouldn't be advisable.

So, how do I establish credit when I have none? (I have tried applying for Capital One online but got denied). I always pay my bills on time, manage my money well, and I never spend beyond my means.


another credit card to build up more credit....ok so i have about a year and a half of credit with a charge account wiht macy...only a $100 limit on macy and a capital 1 with $300 limit.....and reports are all ok except for one pass 30 day late for capital 1 eleven months ago...a charge account from a jewlery store ..i paid about $700 for it in 6 months....it was paid off in may of 2008 ...and after that they only report on my credit report satisfactory every other month

I also had a signature loan for $500 and made 4 ok month payments on it before it was transfered over to an auto loan....i got an auto loan for $1500 and the remainder of $300 balance fromt he signature loan was added to the auto loan...so essentially the auto loan was for abotu $1800.....that was for an 18 month loan..but i paid it off in 13 months...paid it off last month....ok...so based on my credit history....what kidn of credit card can i get? i checked my credit report and got 717 from transunion...i got it from transunion.....and it says i need more revolving account....or what department store credit card should i get...or one that will take me? especially one that checks transunion...but if u have the info...easy cards that check other credit bureaus as well...man it's taking forever!! to build up credit...
what is a vantage score?> i did get the score from www.transunion.com ....with all the payments i've made for the past year and a half...and the jewelry store for 2 years....I've only had one 30 day late, that impacts that much? what if i have it taken off? would it improve it so much more?
and no i checked it's my FICO score....ranges up to 850....not 900

Reason why I ask is because I no longer want the card since their terrible but it was over the phone and I didn't give a social but gave name address and so on and I don'r want that to show credit report


My wife paid off the entire account balance that was on our credit card statement. We pay electronically and don't receive paper statements. Anyway, She called in today to cancel the Credit Card because their interest was too high. To her confusion they said she owed $41.05. She called in and they stated that they charge interest from the date that the statement was sent out. I called in and told them that doing that would make it impossible to pay the full balance because every statement you get wouldn't have the right "New Balance" because every day it would be growing. What I learned from all this is DON'T USE CAPITAL ONE! They did eventually agree with me that it makes no sense to do that, and did credit my account and make it a $0 balance. It only took talking to someone from India, Philippines and then finally someone from TX before it got corrected.


I really want to rebuild and there offering a capital one secured card.

I have an idea to help rebuild my delapidated credit rating. Without going into too much detail into how it got delapidated, basically I owe money to creditors.

I currently am out of work and can only pay small sums to my creditors, with 2 standing orders each for A?X amount, out of my bank account to the creditors each month.

I have a credit card with Capital One that has been sitting dormant for years with no usage for at least 3-4 years whatsoever. Is it possible to set up a monthly standing order off a credit card?

If so I plan to pay my creditors the same A?X amount on a monthly basis as I am already, but off the Capital One card. On the same day this happens I pay Capital One from my bank using a direct debit for the full amount, no interest to pay as it's the same day. This way I still get to pay my creditors but I also help rebuild my credit rating at the same time.

Good idea or bad idea?


I've had my Capital One Card in good standing for about 2 and a half years. Never went over my limit, always paid my bill on time(usually a couple weeks early) and now that I haven't gottena letter in the mail saying they raised my credit, I requested a raise. Sure enough they turned me down and I call them and an Indian lady tells me I am not eligible but won't give me an explanation. Any idea why?


I turn 18 on march 31 on this year and the first thing i did was get a credit card. I being balancing it well. my credit limit startled at 1000 now is 2000. I have an additional 2000 save up in the bank. I apply for a loan with my credit holder(Capital One) and I got denied what can i do.


I have a house to sell lived in it for 3 years next feb no missed mortgage payments I have a loan will be finished in feb 2010 no missed payments and a capital one credit card was a little late with some payments but on time for the last 6 months plus. When I checked my score with credit expert it was 544 - please help. My mortgage adviser says I need 25% deposit if I have 15% can the other 10% be vendor gifted?


Alright I Have A Dilemma On My Mind Right Now I Know That By Canceling My Oldest Credit Card Will Hurt My Score But i Dont Use it At All I Have 6 Credit Cards The 2nd Longest Credit Card Is The One I Use Most Often I Am Planning To Get Rid Of 2 Of The Newest Card That I Apply And Also Getting Rid Of Oldest Card Which I Hate Capital One So Basically I Want To Just Keep At Most 3 Cards Should I Just Go Ahead And Execute My Plan Or Would This Plan Hit Hard On My Credit Score Ive Had Capital One For About 3 Years and 2nd Card About 2 Years And 6 Months Please Give Me Some Advice Thanks

Impossible to find website x sells incredible product x only on website.

Is it legal for me to take their incredible product x and sell it on places like ebay at small mark uplike I owned it new in box? Once order recieved I simply purchase under buyers name.

Many sellers on ebay appear to do something similiar to this.

-Would have shipping math worked out/ or priced so as to be irrelevant
-Would be just like selling an unwanted coffee maker you got from christmas right?
-Would spare obsene amount of capital you risk in order to get bulk discount but would only put you in red if it didn't sell.
-Also get discount through credit card cashbackery and rarely through things like windows live and other affiliate sharing things.


I already know of several high end items, but do no want to go around trying to set up proper drop ships as most people won't bother to give so much as a response unless your a set/proven buyer.

So is this legal. I don't think its infringement as nothing is modified/rebranded/renamed. It is just like having a friendly worker bee appear and pushing your product and people would be getting at price sales so....

Anyways is this legal/common? I know it is much cheaper to get set up in bulk buys but that requires a proven history that it will sell and large capital but this method seems to have benefits for proving/poor folks like mua.


I've heard Capital One and Orchard Bank are good choices but I don't know anything about either one nor do I have experience with credit. So who offers the best secured credit card for the building of credit?


Before I start, I want to say that I am not saying any of these things as excuses for my situation, because I take complete responsibility, but I want to give a bit of background.

I grew up in a very abusive home, and made some extremely bad choices. I ran away from home, got into drugs and alcohol, etc.

I did graduate high school, but did not go to college. Later, after I cleaned up my life and decided to become a productive member of society, I made another bad choice. I decided to go to ITT Technical Institute rather than a university.

This cost me about 30,000 in student loans, which I didn't really understand the reprocussions of at the time.

After that, I didn't get a great job like they promised me. I ended up working tech support in a call center. I had an extremely hard time making my rent, bills and the insanely high payments the student loan people asked of me.

Because of that, I also ended up with A LOT of credit card debt.

My student loans are defaulted and my credit is totally ruined. It's around 400 right now.

I just found out I was sued by Capital One. I did not get served papers or anything and didn't even know they were suing me. I called the court because I got paperwork saying Capital One won the lawsuit by default since I did not show up. I told them I didn't even know I was being sued. They said they had on record that they tried to mail me the summons but that it was returned to the post office for some reason. They said a notice was "posted to my door."

Well, I live in an apartment complex with my door facing a major road. Anything could have happened if they simply stuck a paper on my door. I never saw one so for all I know it blew away or someone ripped it off.

Long story short, I am in deep trouble.

I have fought really hard to try to salvage my life and make amends for my bad choices, but it feels like for every step forward, I take 3 steps backwards. I don't know how to get ahead with everything stacked against me.

I can barely make my rent and bills right now.

I want to go to a real university and get a real degree so I can get a good high paying job and settle my debts, but I can't even do THAT since my student loans are in default!

(Can't get money if I can't get school, can't get school if I can't get money.. Again, don't know how to win here!!)

So, if anyone out there can give me some advice on how to save myself, please help me.

I have considered bankrupcy to get out of some of my debts, since my credit is already destroyed, but I don't know if that will make it impossible for me to get a car when my lease runs out. (In about 6 months.)

I also don't have the cash to pay a lawyer for bankrupcy... :(

I am really stuck here. What can I do to fix this?
